Although a Supreme Court justice in the Bahamas last month declined to recognize its recent U.S. bankruptcy filing, the same justice has granted it leave to appeal his previous ruling, Baha Mar Ltd., developer of the unfinished Baha Mar resort in the Bahamas, announced yesterday.

Justice Ian Winder previously stated that Baha Mar's U.S. bankruptcy was invalid in the Bahamas, leaving the developer on the hook for debts related to the mired resort. His decision to hear an appeal means the battle between Baha Mar and China Construction America (CCA) -- the resort's general contractor -- will wage on.

In a statement released yesterday, Baha Mar said it is "gratified" by Justice Winder's decision.
